TWIGGLUE — TERMS OF SERVICE & SALE

1. Acceptance of Terms

By accessing twigglue.com (the "Site") or purchasing any TwigGlue™ kit or accessory (the "Products") you agree to these Terms of Service & Sale ("Terms"). If you do not agree, do not use the Site or order Products.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter a contract.

3. Product Information & Instructions

Each TwigGlue kit contains ≤ 1 oz (30 mL) of two-part epoxy resin packaged in syringes, along with sandpaper, tape, gloves, and printed instructions. A current Safety Data Sheet (SDS) is shipped inside every box and posted at twigglue.com/safety.

Read the SDS and follow all safety directions before opening or using the kit.

4. Orders, Pricing, Payment

All prices, taxes, shipping, and hazardous-materials surcharges appear at checkout. We may reject or cancel any order (with a full refund) for suspected fraud, inventory errors, or legal restrictions.

5. Shipping & Haz-Mat Notice

TwigGlue epoxy resin is classified as UN 3082, Environmentally Hazardous Substance, Liquid, n.o.s., Class 9. Shipments travel under the IATA / 49 CFR limited-quantity exception applicable to inner containers ≤1 L and outer packages ≤30 kg. Packages carry the required Class 9 diamond label and documentation.

5-B. International Orders, Duties & Taxes

5-B-1 Importer of Record (IOR)

For any destination outside the United States, you (or your named recipient) are the IOR and solely responsible for obeying local laws, clearing customs, and paying import duties, taxes, brokerage fees, and carrier surcharges.

5-B-2 VAT & GST

When supported, our Shopify checkout will collect VAT/GST and list it on your receipt. If local law requires additional amounts—or Shopify cannot collect them—you agree to pay those charges on delivery. Duties, taxes, and haz-mat fees are non-refundable.

5-B-3 Delivery Terms

Unless the checkout page states otherwise, shipments travel DAP ("Delivered at Place," Incoterms 2020). Title and risk of loss transfer to you when the carrier scans the parcel at our warehouse.

5-B-4 Customs Delays & Refusals

We are not liable for transit delays due to customs inspection. If you refuse delivery or fail to pay assessed charges, the parcel may be abandoned or returned; we will refund only the product price minus original shipping, haz-mat, and any return costs.

5-B-5 International Returns / Right of Withdrawal (EU/UK/EEA)

  • Unopened kits may be returned within 14 days of receipt.
  • Before shipping the return, email [email protected] to obtain an RMA and the EU withdrawal form.
  • You must ship the product back in dangerous-goods-compliant packaging and pre-pay all duties, taxes, and carrier fees.
  • We will refund the product price (less original freight/haz-mat) within 14 days after the goods arrive in salable condition.

6. Handling & Safety — YOUR ASSUMPTION OF RISK

  1. PPE Required. Wear nitrile gloves, eye protection, and work in a well-ventilated area.
  2. Follow Instructions. Incorrect mix ratios, inadequate cure time, or use on unsafe sticks can cause failure or injury.
  3. Keep Away from Children. Not a toy.
  4. Proper Disposal. Follow local hazardous-waste rules for unused resin and syringes.

By purchasing and using TwigGlue, you voluntarily assume all risks—including skin irritation, allergic reaction, property damage, or bodily injury—arising from handling or using epoxy resin and related materials.

7. Disclaimer of Professional Advice

Content on the Site and in the instructions is for general information only and not professional engineering or safety advice.

8. Returns & Limited Warranty (U.S.)

Unused, unopened kits may be returned within 30 days of delivery for a refund of the product price (shipping and haz-mat fees non-refundable). We warrant that unopened Products will be free from manufacturing defects until the "Best By" date on the package. Your exclusive remedy is replacement or refund, at our option.

9. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Release & Limitation of Liability

To the fullest extent permitted by law, you release and hold harmless Howell Labs, LLC, its members, employees, and agents ("Released Parties") from any and all claims, damages, or losses—including personal injury or death—arising from or related to the Products or Site.

IN NO EVENT WILL THE RELEASED PARTIES' TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE. Some jurisdictions do not allow limitations on liability for personal injury; if that law applies to you, this limitation may not apply.

11. Indemnification

You agree to indemnify and defend the Released Parties against third-party claims arising from your breach of these Terms or misuse of the Site or Products.

12. Intellectual Property

All TwigGlue trademarks, logos, text, and images are owned by Howell Labs, LLC. You receive a limited, revocable license to view and print Site content for personal, non-commercial use.

13. Export-Compliance & Sanctions

Products are classified EAR99 under U.S. export regulations. By ordering, you certify that (i) you are not on any U.S. or international denied-party list, (ii) you will not export or re-export the Products to embargoed countries, and (iii) you will not use the Products for prohibited end-uses. We reserve the right to cancel or refuse any order that conflicts with export-control or sanctions laws.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.

Mandatory Arbitration. Any dispute shall be resolved by binding arbitration in Pinellas County, Florida under the Commercial Arbitration Rules of the American Arbitration Association. Class-action waivers apply.

15. Changes to Terms

We may modify these Terms at any time. Material changes take effect 30 days after posting a revised "Last updated" date. Continued use of the Site or purchase of Products after that date constitutes acceptance.
